This Privacy Policy explains how N-SAID Holding, LLC ("Selling Navigator", "we", "us", or "our") collects, uses, and discloses information about you when you access or use our website (https://sellingnavigator.com) and our SaaS platform (the "Service").

3.1 Our Roles: Controller vs. Processor

Under applicable data protection laws (such as the GDPR), we act in two different capacities:

  • Data Controller: We act as a Controller for the personal data of our direct Customers (e.g., account registration details) and website visitors.
  • Data Processor: We act as a Processor for the data that our Customers upload, store, or process within the Service regarding their own clients, employees, or leads. This relationship is governed by our Data Processing Agreement (DPA), which is incorporated into our Terms of Service.

3.2 Information We Collect as a Controller

A. Information You Provide to Us

  • Account Data: Name, email address, password (hashed), company name, and phone number provided during registration.
  • Support Communications: Emails sent to support@sellingnavigator.com.
  • Payment Information: Our order process is conducted by Paddle.com (Merchant of Record). Paddle collects your billing and payment information. We do not collect or store full credit card numbers.

B. Information Collected Automatically

  • First-Party Analytics: We collect IP addresses, country/city location (resolved locally via MaxMind database, not shared externally), browser type, device type, and visited pages. This data is retained for a maximum of 730 days.
  • Cookies: We use strictly necessary cookies (session management and XSRF protection) required for the Service to function. We do not use third-party tracking cookies or advertising pixels.

3.3 How We Use Your Information

  • To provide, maintain, and improve the Service.
  • To process transactions and send related information (invoices, confirmations) via Amazon SES.
  • To respond to your comments, questions, and customer service requests. Note on AI: Incoming support emails may be pre-processed and categorized using Artificial Intelligence (Google Gemini, EU region) to suggest responses. All AI-suggested responses are reviewed and approved by a human agent before being sent.

3.4 Sharing and Sub-processors

We do not sell your personal data. We share data only with trusted third-party service providers (Sub-processors) to operate our Service:

  • Hosting & Infrastructure: Hostinger (VPS hosting) and Cloudflare (DNS).
  • Payments: Paddle (Merchant of Record).
  • Communications: Amazon SES (transactional emails).
  • AI Services: Google Gemini (support and optional task generation) and OpenRouter (optional task generation).
  • Avatars: Gravatar (Automattic) for chat avatars (using an email hash).

3.5 Data Retention and Deletion

  • Account Data: If you cancel your subscription or your account expires, we retain your platform data for 90 days to allow for reactivation or data export. After this period, your data will be permanently deleted from our active servers.
  • Backups: System backups are retained for a limited time (last 5 backups) and are overwritten automatically.

3.6 International Data Transfers

We are based in the United States. Information we collect may be transferred to, and processed in, the US or other countries. We rely on legally provided mechanisms, such as Standard Contractual Clauses (SCCs) or the EU-US Data Privacy Framework, to lawfully transfer data from the EU/EEA to the US.

3.7 Your Rights

Depending on where you live (including under the GDPR and applicable US state privacy laws), you have the right to request access to, correction of, deletion of, or a copy of your personal data, to restrict or object to its processing, and to withdraw consent where processing is based on consent. You also have the right to lodge a complaint with your local data protection authority. If your data was uploaded by one of our Customers (for example, your employer or a company you deal with), please contact that Customer first, as they control that data.
